DiveOne Planner — Terms of Service

In plain language (the short version)
- DiveOne Planner is a free planning aid — a calculator. It is not a dive computer and not a substitute for training, certification, official tables, professional judgement, or your primary dive computer.
- Diving is dangerous. You are responsible for your own dive decisions and safety. Always dive within your training and use redundant instruments.
- The Service is provided "as is", with no guarantee of accuracy. To the extent the law allows, we are not liable for dive outcomes.

1. Agreement
By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 (or the age of majority where you live) and legally able to enter this agreement. The Service is intended for appropriately trained and certified divers (or those training under qualified supervision).
3. The Service is an auxiliary planning aid — safety (READ THIS)
3.1 DiveOne Planner computes illustrative decompression information (Bühlmann ZHL-16C with Gradient Factors) in your browser, for planning purposes only.
3.2 It is NOT, and must never be used as: a dive computer; a substitute for a primary or backup dive computer; a substitute for certified training, professional instruction, official dive tables, or your own judgement; a medical device or medical advice.
3.3 The model does not account for your individual physiology, health, medical conditions, fitness, hydration, age, PFO, or actual in-water conditions. Decompression diving carries inherent risks, including serious injury, decompression sickness, and death.
3.4 You must always dive with appropriate certification, within the limits of your training, and with functioning redundant instruments. Never rely on this Service alone.
4. Assumption of risk; your responsibility
Scuba diving is a hazardous activity that you undertake voluntarily and at your own risk. You are solely responsible for all dive planning and in-water decisions. You agree to independently verify any output and to follow the guidance of your certifying agency, instructors, and dive professionals.
5. No warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, and uninterrupted or error-free operation. We do not warrant that any calculation is accurate, complete, or appropriate for any particular dive.
6. Limitation of liability
6.1 To the maximum extent permitted by law, DiveOne and its officers, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill.
6.2 To the maximum extent permitted by law, we are not liable for any personal injury, decompression sickness, illness, death, or other harm arising out of or related to diving or the use of (or inability to use) the Service.
6.3 To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim (for a free service, this may be zero) or (b) USD 100.
6.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence where such exclusion is prohibited, or for fraud). Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you and you may have additional rights.
7. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless DiveOne from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your dives, your breach of these Terms, or your violation of any law or third-party right.
8. Accounts
You are responsible for the accuracy of your registration data and for keeping your credentials secure. You may delete your account at any time in the app (self-serve deletion). We may suspend or terminate accounts that violate these Terms or for security or legal reasons.
9. Acceptable use
You will not: misuse, disrupt, reverse-engineer (except as permitted by law), or overload the Service; use it for unlawful purposes; attempt unauthorised access; or rely on it as a primary or sole dive-safety instrument.
10. Intellectual property; your content
The Service, brand, and software are owned by DiveOne and its licensors. The decompression methodology and reference test vectors are published transparently ("Verify our math") for inspection. Your content — the plans, logs, and notes you create — remains yours; you grant us a limited licence to host, process, and display it solely to operate the Service for you. Shared plan links you create are read-only snapshots you choose to distribute; you are responsible for what you share.
11. Third-party services
Sign-in is provided via Apple and Google under their respective terms. We are not responsible for third-party services.
12. Changes
We may modify the Service or these Terms. For material changes we will give notice (in-app or by email). Continued use after the effective date constitutes acceptance.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access as described above. Provisions that by their nature should survive (including 3–7, 10, and 14) survive termination.
14. Governing law & disputes
These Terms are governed by the laws of the Kyrgyz Republic, without regard to conflict-of-laws rules. Any dispute shall be subject to the competent courts of Bishkek, Kyrgyz Republic. If you are a consumer in the EU/EEA or in another jurisdiction with mandatory protections, you keep the rights and protections granted by the mandatory law of your country of residence and may bring proceedings there.
15. General
If any provision is unenforceable, the remainder stays in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. Neither party is liable for events beyond its reasonable control (force majeure).
